Terms & Conditions: Border Crossings Auction

The Terms and Conditions of the Border Crossings Auction differ from those of Waddington’s (onlineauctions.waddingtons.ca).

Please note: There is no buyer’s premium and no taxes apply to the work purchased. All work will be shipped from Winnipeg. The cost of packing is a flat rate of $75 per piece and will be added to the purchase price. Border Crossings will invoice the buyer at the email address they register with at Waddington’s.

Terms of Bidding

Bidders must register at onlineauctions.waddingtons.ca in order to participate in the auction.

The bidder’s email address, as registered with Waddington’s at onlineauctions.waddingtons.ca will be shared with Border Crossings for administrative purposes. The email will be used for auction-related communications only. The auction begins on Saturday, February 20 at 8:00 am CST / 9:00 am ET.

All sales are final. No purchase can be returned, refunded or exchanged. Bidders are legally responsible for all bids that they have placed, even if a bid has been placed in error.

The Estimate reflects the market value of the piece. The starting bid is the same for all pieces included in the auction and is the minimum amount for which the piece can be sold.

Successful bidders must pay for their purchases by Visa, American Express or Mastercard, online within 48 hours of receiving their invoice, unless otherwise arranged by emailing Teigan Harrison, the authorized representative of Border Crossings at [email protected]

A proxy bid is the highest price a bidder is willing to pay for a lot. Your bidding stops when your proxy bid is reached, or the auction closes. Your bid will automatically increase every time someone bids against you by the next bid increment until your proxy bid is reached. The Quick Bid button is a way for you to bid the next bid increment immediately. It is often used in the last minutes of an auction when bidding becomes more aggressive.

Lots are listed in the numeric order by which they will close. Lots begin closing in groups of 25 lots every 10 minutes on the final day of the auction on Sunday, February 28, 2021 at precisely 6:00 pm CST / 7:00 pm ET. For example, lots 1 to 25 may close at 6 pm CT, while lots 26 – 50 may close at 6:10 pm CT, and so on, until all lots are closed.

If a bid is placed on a lot within the last 5 minutes of bidding on that lot, the lot’s auction end-time will extend 5 minutes from the time the last bid is placed. This will continue until there is no bidding for 5 minutes on each lot.

Bidders will be notified by email when they are outbid, and will also receive an alert if they are on the bidding site at the time they are outbid.

The Buyer will be notified of their purchase by email, on Monday March 1, 2021 or Tuesday, March 2, 2021. Invoices will be sent by email Wednesday, March 3 by 5:30 pm. The purchase price and packing will be noted on the invoice. Payment must be received within 48 hours. Shipping costs will be invoiced separately once the method of shipping has been selected. In the case of identical bids, the earliest received will take precedence. Border Crossings and Waddington’s are not responsible for technical errors or failures to execute bids.

The Buyer will be the highest bidder for the lot and the Buyer immediately assumes full risk and responsibility for the lot. When you register for your bid paddle, you are agreeing to these rules.

Bid increments differ depending on where the price of the piece is at the time of the bid:

$600 to $999 ($50 increments)
$1,000 to $1,999 ($100 increments)
$2,000 to $4,999 ($250 increments)
$5,000 to $9,999+ ($500 increments)

All preview catalogue descriptions at auction.bordercrossingsmag.com are subject to any variation found in the online auction listing at onlineauctions.waddingtons.ca when the auction opens on Saturday, February 20, 2020 at 8:00 am CST. Border Crossings reserves the right to withdraw any work of art at any time before the actual auction begins.

Conditions of Sale
By bidding at auction, bidders are bound by the Conditions of Sale and Terms of Bidding, as amended by any announcements, lot descriptions or posted notices, which together form the contract of sale between the successful bidder (buyer), and Border Crossings (auctioneer).

Each lot lists an estimated market value obtained from sources Border Crossings believes to be reliable. This estimated value is intended as a guide to assist attendees in their bidding. No representation or warranty as to the resale value of a work being auctioned is made or implied.

All artworks are in excellent condition unless otherwise stated. Sizes are approximate. Descriptions or photographs of lots are not warranties and each lot is sold “as is” in accordance with the Conditions of Sale.

Shipping, Delivery, Pick-Up

Border Crossings will take responsibility for arrangement of shipping but payment is the buyer’s responsibility. Upon completion of the auction Border Crossings will email the Buyer and provide them with shipping, delivery and pick-up options, as applicable to their and the artwork’s location. Border Crossings will quote shipping with Armstrong Fine Art Services, or FedEx with any applicable limits on liability and insurance. Declared value or added insurance is at the Buyer’s discretion.

Shipping will be calculated based on the size, weight and destination of the purchased piece. All pieces are shipping from Winnipeg, MB.

We will arrange shipping, delivery or pickup for every purchase in accordance with and due to the Government’s guidelines concerning Covid-19. We will store purchases free of charge at a secured location should restrictions delay any shipping, delivery or pickup of the sold works.

All buyers will receive a 1-year subscription to Border Crossings Magazine. If you are already a subscriber, this can be used as a gift subscription, as well.
